Foreign national prisoners facing expulsion. The percolation of migration law enforcement into sentence implementation decision-making on release in Belgium. (FWOTM874)

CONTEXT
Nation states have adopted penal early release procedures for foreign national prisoners (FNPs) that are linked to migration law enforcement, though to differing degree. Additionally, FNPs are prioritized for expulsion and subjected to further administrative detention and lengthy entry bans under migration law due to their criminal law violations.

LACUNA
Despite the emerging intertwining of criminal and migration law enforcement, criminologist tend to understand early release decision-making from a strict penal perspective. In addition, criminology currently lacks comparative qualitative research based on extensive fieldwork explaining migration law decision-making mechanisms regarding FNPs and the implications of criminal involvement under migration law.

SCOPE
The similarities and differences in penal and migration policy regarding FNPs between Belgium, the Netherlands and the UK make these countries an ideal testing ground to compare migration law enforcement in prison as well as early release and migration law decision-making on FNPs.

ADDED VALUE
The project fills the current knowledge gap in criminology regarding the implications of the intertwining of criminal law enforcement and migration law enforcement at the back door of the criminal justice system regarding FNPs, notably the most striking examples of the late modern penal-migration configuration in an age of globalization and migration.
