Addressing the legacies of the past : historical commissions in consolidated democracies

In this chapter on a type of institution rather than a specific country context, Cira Pallí-Asperó describes the nature of historical clarification commissions and discusses the extent to which they can be considered a mechanism of transitional justice. She relies on a functional definition of these commissions and discusses the extent to which consolidated democracies have used them for purposes that align with those of transitional justice. She argues that historical commissions constitute an alternative, truth-seeking mechanism located away from the legal domain. The chapter has two parts. The first part describes the paradigm, mandate and approach of historical commissions and the way in which they help create new historical narratives. The second part discusses the links between such commissions and transitional justice.
