Abstract:The present study analyses whether, and how, International, European and Spanish Law on International Protection are applicable to two specific instances of persecution: first, that based on the erroneous perception of a heterosexual and cisgender person as homosexual, bisexual, trans* or intersexual, and, second, that due to the victim’s association with LGBTI people. To this end, we will also examine the concept of discrimination by association, recently developed at European level, and we will suggest its possible extensive application in the field of the international protection on grounds of sexual orientation and gender identity.
