The ADR Agreement – Filling in a Blind Spot in European Private Law

This research aims to study whether and how a European law regulating the ADR agreement could advance ADR in a European cross-border context. It envisages to examine (1) the binding effect of an ADR agreement; (2) the parties’ obligations under an ADR agreement (3) and their enforceability; (4) which rules can best govern these various questions in a transnational context.
