A scoping review on the role of race and ethnicity in criminal justice diversion to treatment

Korte inhoud:Existing research on these criminal justice diversion options is primarily concerned with the effectiveness of criminal justice diversion to treatment in reducing recidivism and in lived experiences. It pays little attention to disparities in the application of criminal justice diversions to treatment, let alone to the role of extralegal variables like race and ethnic background in that regard. To gain insight into what current research shows about race and ethnic disparities in criminal justice diversion of primary drug users to treatment programs, this chapter executes a scoping review that identifies the extent, range and nature of existing research. A total of 12 studies have been identified through a systematic search strategy, examined for inclusion, coded and analysed. The review showed considerable overlap between the literature on racial and ethnic disparities in criminal justice diversion to treatment and the literature on racial and ethnic disparities in the decision to incarcerate. It simultaneously showed how, although offenders of a minority race are less likely to be referred to treatment through the criminal justice system, criminal justice still appears to be the largest referral source for clients of a minority race. The conclusion discusses these results in a broader context.
